Terms and Conditions of Purchase and Sale
1. General Provisions
1.1. These terms and conditions (hereinafter referred to as the "Terms") constitute a legally binding document between the Buyer and the Seller (hereinafter referred to as the "Seller"), establishing the rights and obligations of the Parties.
1.2. The Seller reserves the right to amend, modify, or supplement these Terms at any time. The Buyer shall be informed of any changes to the Terms on the electronic store's website.
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded when the Buyer places an order for goods in the electronic store, having previously familiarized themselves with these terms.
3. Seller's Rights
3.1. In significant circumstances, the Seller may temporarily or completely suspend the operation of the electronic store without prior notice to the Buyer.
3.2. If the Buyer attempts to disrupt the operation, stability, or security of the electronic store or violates their obligations, the Seller has the right to restrict or suspend the Buyer's access to the electronic store without prior warning.
4. Seller's Obligations
4.1. The Seller undertakes to provide access to the services of the electronic store, the terms of operation of which are defined by these Terms.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer by the delivery method chosen by the Buyer, based on the conditions set forth in these purchase and sale Terms.
4.3. In unforeseen circumstances where the Seller cannot deliver the goods ordered in the electronic store, the Seller has the right to terminate the Purchase and Sale Agreement after informing the buyer. The Seller may offer a similar product. If the Buyer refuses, the Seller undertakes to refund the payment within 3 working days.
4.4. If the Buyer exercises the right provided in clause 5.2 of the Terms, the Seller undertakes to refund the payment made by the Buyer within 5 (five) working days from the date of receipt of the returned goods by the Seller.
4.5. The Seller may withhold the Buyer's payment until the goods are returned to the Seller or until the Buyer provides evidence that the goods have been shipped to the Seller, whichever occurs first.
5. Buyer's Rights
5.1. The Buyer has the right to purchase goods in the electronic store in accordance with these Terms.
5.2. The Buyer has the right to withdraw from the concluded purchase and sale agreement in the electronic store by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery of the goods.
5.3. The right of the Buyer discussed in clause 5.2 may be exercised only if the goods were not damaged or substantially changed in appearance, and if they were not used.
6. Buyer's Obligations
6.1. The Buyer must pay for the purchased goods and accept them in accordance with these Terms.
6.2. If, during the delivery of the goods, the Buyer refuses to accept the goods without significant reasons, but the goods are delivered to the address specified by the Buyer, the Buyer is obligated, upon the Seller's request, to cover the costs of returning the goods.
6.3. During the delivery of the goods to the Buyer, the Buyer must inspect the shipment and the condition of the goods together with the Seller or the person delivering the shipment.
6.4. By using the electronic store, the Buyer confirms that they agree to these purchase and sale terms and undertake to comply with them.
7. Prices of Goods
7.1. The prices of goods in the electronic store are indicated in euros. Prices are quoted including VAT. Upon confirmation of the order, the total amount of the goods is increased by the delivery fee, if applicable.
8. Ordering and Payment for Goods
8.1. The Buyer, visiting the electronic store, selects the desired goods, adds them to the shopping cart, and fills in the personal data necessary for order fulfillment: their name, surname, address for delivery of goods, telephone number, and additional information that may be important for delivering the ordered goods. The Buyer confirms that they have read these terms and confirms the order.
8.3. Payment can be made using electronic banking services provided by Swedbank, SEB, Luminor, Citadelė, Šiaulių Bankas, as well as Visa/MasterCard payment cards. Payments are processed using the MakeCommerce.lt payment platform.
9. Delivery of Goods
9.1. When ordering goods, the Buyer must specify the exact delivery address for the goods.
9.2. The Buyer must accept the goods themselves. If the Buyer cannot accept the goods themselves, but the goods are delivered to the address specified by the Buyer, the Buyer has no right to make claims regarding the goods delivered to an inappropriate person.
9.3. The Seller delivers the goods to the Buyer in accordance with the terms indicated in the descriptions of the goods.
9.4. The characteristics of all goods sold are indicated in the description of each product. The Seller is not responsible for discrepancies between the color, shape, or other parameters of the goods in the electronic store and the actual size, shape, and color of the goods due to the Buyer's monitor settings.
9.5. If the Buyer refuses to purchase the goods, all amounts paid by the Buyer, including the delivery costs paid by the Buyer, are refunded.
10. Return of Goods
10.1. Quality goods can be returned within 14 days from the date of receipt. Defects of sold defective goods are eliminated, defective goods are exchanged, and returns are made in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2. When returning goods, the following conditions must be observed:
10.2.1. The returned item must be in its original undamaged packaging (this point does not apply in the case of returning defective goods);
10.2.2. The item must not be damaged by the Buyer;
10.2.3. The item must be unused and retain its commercial appearance: intact labels, unpeeled protective films, etc. (this point does not apply in the case of returning defective goods);
10.2.4. The returned item must be in the same configuration as received by the Buyer (this point does not apply in the case of returning defective goods);
10.2.5. The Seller has the right to refuse to accept the Buyer's returned goods if the conditions for returning the goods are not met;
10.2.6. The return of goods is carried out in the manner determined by the Seller within 14 (fourteen) days from the date of receipt of the goods (this point does not apply in the case of defective goods - in this case, the return of goods is carried out within the statutory warranty period);
10.3. The return and exchange of goods of appropriate quality are carried out in accordance with Article 6.22810 of the Civil Code;
10.4. Payments for goods accepted by the Buyer but later refused are refunded to the Buyer's account no later than within 5 (five) days from the date of the return of the goods to the Seller, unless otherwise agreed between the Seller and the Buyer.
11. Final Provisions
11.1. These Terms are drawn up in accordance with the laws of the Republic of Lithuania.
